These general conditions of sale govern the sale by Diagnostic CEM to its customers of the products presented on the website: www.diagnostic-cem.shop (the online store), www.diagnostic-cem.shop/boutique.


The customer undertakes to read these General Conditions of Sale carefully and to accept them before proceeding to payment for an order for products placed on the website (the Diagnostic CEM online store).


PRODUCTS:

The products sold on the online store www.diagnostic-cem.shop are new, with the manufacturer's warranty, comply with European standards and authorized for sale in France and Europe.

Products marked with the "out of stock" label are subject to a restocking period of 1 to 2 weeks.


ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE:

ORDER AND RESERVATION OF OWNERSHIP:

The order placed by the customer on the website: www.diagnostic-cem.shop will only be definitively validated after receipt by Diagnostic CEM in its bank account of the full amount allowing the effective payment of this order.

The products remain the property of Diagnostic CEM until full payment of the invoice.


PAYMENT TERMS:

The customer pays for their products online on the website: www.diagnostic-cem.shop using the payment methods provided by the website.

The customer is authorized to use the payment method he has chosen to pay for his purchases online.

The website www.diagnostic-cem.shop will take all measures to guarantee the security and confidentiality of data transmitted by the customer when paying for their products online.

All payment information entered by the customer is encrypted and secure and is not processed on the site but between the customer's payment institution and the site's payment institution.

For fraud prevention reasons, Diagnostic CEM reserves the right to request proof of your identity, address, and payment method when accepting a sale. If you pay by check or bank transfer, your order will be held for 2 weeks (14 calendar days). If your payment has not reached us within this timeframe, your order will be cancelled and the product will be returned to stock.


DELIVERY TIMES:

Delivery times are indicated when the customer places an order on the website: www.diagnostic-cem.shop. The usual delivery time is 2 to 7 working days for continental Europe, including the time taken to process the order and the actual delivery. The usual delivery times for other destinations are indicated to the customer when placing their order. Any order placed on a working day in France before 2:00 p.m. and for which payment has been received by Diagnostic CEM in its bank account before 2:00 p.m., Monday to Friday, will be processed the same day. Any order placed on a working day in France after 2:00 p.m., Monday to Friday, will be processed the following working day if the payment has arrived in Diagnostic CEM's bank account the following working day before 2:00 p.m. The order processing time is 1 working day.

The delivery times indicated to the customer when placing their order are indicative delivery times. These delivery times are given as working days in France.

It is specified that deliveries will be made within a maximum of thirty (30) days for delivery addresses located in the European Union. Failing this, the customer must formally notify the seller to deliver within a reasonable time and in the event of non-delivery within this time, the customer may terminate the contract.

It is also specified that deliveries will be made within a maximum of forty (40) days for delivery addresses located in our delivery area outside the European Union. For customers located in the United Kingdom or in states or territories within our delivery area that are not members of the European Union Customs Union, customs duties may be payable upon receipt of the package in addition to the product prices displayed in the Diagnostic CEM online store: www.diagnostic-cem.shop. SHIPPING COSTS:

Shipping and delivery costs are not included in the prices displayed for the various products on the website: www.diagnostic-cem.shop. They depend on the products and the delivery locations. Shipping and delivery costs are indicated to the customer when placing their order. For certain products and for certain destinations, free delivery (free delivery) may be applied; this will be indicated to the customer when placing their order.


WITHDRAWAL, CANCELLATION, REFUND, PRODUCT RETURN:

The withdrawal procedure described in this section of our General Terms and Conditions of Sale applies only to individual customers. Professional customers do not benefit from this withdrawal procedure. The right of withdrawal for professionals is governed by Article L.221-3 of the French Consumer Code.

The customer has a period of fifteen (15) days from the date of receipt of the product(s) purchased to exercise their right of withdrawal in good and due form.

Return costs are borne by the customer. A restocking fee of 10% of the order amount excluding delivery will be retained.

In order for the withdrawal period to be respected, the customer must imperatively send his request relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.

Products must be returned in their original packaging and in their original packaging in perfect condition (no scratches, no tears in plastic bags, boxes, labels, etc.) with all accessories (batteries, manuals, etc.). Products sold in jars, bottles or flasks must not have been opened.

The products must be returned no later than 14 days after sending the withdrawal.

We do not accept returns of orders to parcel collection points or to any address other than that of the company.

Diagnostic CEM undertakes to reimburse the customer by bank transfer in the event that their request to exercise the right of withdrawal is admissible within fourteen (14) days after receipt of the products.

Professional clients benefit from the withdrawal procedure described in French law n° 2014-344 of March 17, 2014.

Products returned by customers will have their packages opened under video surveillance to avoid any dispute over the condition of the returned products.

Electromagnetic wave protection materials cut to order for each order (anti-wave canvases, anti-wave fabrics, anti-wave films, etc.) cannot be returned or exchanged.

Bed canopies that have been opened and unpacked cannot be returned or exchanged as they cannot be reconditioned. Technical products such as anti-radiation clothing and anti-radiation textile items whose packaging is unsealed cannot be returned or exchanged for hygiene reasons. Items that operate with electrical current cannot be returned or exchanged if they have been used (filters, extension cords, power strips, automatic field switches, etc.).

In the event of a package refusal, the shipping and return costs are borne by the customer. A restocking fee of 10% of the order amount excluding delivery will be retained.

In the event that a package is not collected from a collection point within the specified timeframe and returned to our offices, a restocking fee of 10% of the order amount, excluding delivery, will be retained.


WARRANTY AND LIABILITY:

The commercial warranty on products sold by Diagnostic CEM is that applicable by the manufacturers of these products, failing which it is one (1) year.

The customer benefits from the legal guarantee against hidden defects. Any product found to be defective will be replaced by Diagnostic CEM upon return of the defective product. The duration and conditions of this guarantee are those in effect at the time of the order.

The customer also benefits from the legal guarantee of conformity. The duration and conditions of this guarantee are those in effect at the time of the order.

Diagnostic CEM declines all responsibility for the use of products by customers.

Equipment and materials for protection against electromagnetic waves (anti-wave paints, anti-wave fabrics, anti-wave films, electrical equipment, etc.) sold in the Diagnostic CEM online store must be implemented, installed or fitted by qualified specialist companies in accordance with the installation instructions provided by the product manufacturer.

We decline all liability for damage of any kind, particularly to people, animals, property and objects, caused by improper use of anti-wave equipment and materials, including grounding and electrical installation that does not comply with standards (DIN 57100 / VDE 0100, etc.). Checking the electrical installation and grounding of anti-wave protection materials must be carried out by a specialist electrician.


DISPUTES AND COMPETENT JURISDICTION:

Sales or contracts concluded under these General Terms and Conditions of Sale (GTC) are subject to French law. The customer acknowledges that the courts of the location of Diagnostic CEM's registered office shall have sole jurisdiction in the event of legal action.


IMPORTANT :

We take the greatest care in packaging the parcels we send. However, we invite you to carefully check the contents of your package in the presence of the delivery person and, if necessary, to make specific reservations on the carrier's delivery slip (for example: damaged box, ripped open box, crushed box, broken or damaged goods, etc.) and inform us as soon as possible. Please note: the statement "subject to unpacking the package" is not valid. If the products inside the package are found to be damaged, a letter confirming the reservations must be sent by registered mail with acknowledgment of receipt to the carrier within 48 hours. Only these steps can trigger the carrier's insurance. Without this, we will not be able to process any claims or replace your order.
